TERMS OF USE
The owner of the TARCON e-learning platform online store (hereinafter the Online Store) is OÜ TARCON, registry code 16487228, located at A-Torn, Lõõtsa 8A, 15176 Tallinn.
Validity of the Sales Agreement, Product and Price Information
The sales conditions apply when purchasing goods from the Online Store.
The prices of the products sold in the Online Store are indicated next to the products. All prices for goods sold in the online store are in euros.
The delivery fee for the goods depends on the buyer’s location and the delivery method. The delivery fee is displayed to the buyer during the checkout process.
Information about the goods is provided in the Online Store directly next to the item.
Placing an Order
To order goods, the desired products must be added to the shopping cart. To complete the order, the required data fields must be filled in and a suitable delivery method for the products must be selected. Subsequently, the total amount due will be displayed on the screen, which can be paid securely through the following payment methods:

If the ordered goods cannot be delivered due to the stock running out or for any other reason, the buyer will be informed at the earliest opportunity and the money paid (including delivery costs) will be refunded without delay, but no later than 14 days after sending the notification.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days.
NB! Depending on the products, the buyer may not have a right of withdrawal; in such cases, the relevant products and services must be listed and they must meet the conditions listed in § 53 (4) of the Law of Obligations Act.
The right of withdrawal does not apply if the buyer is a legal entity.
To exercise the 14-day right of return, the ordered goods must not be used in any way other than what is necessary to verify the nature, characteristics, and functioning of the goods in the same manner as is permitted for testing goods in a physical store.
If the goods have been used for purposes other than those necessary to verify the nature, characteristics, and functioning of the goods, or if there are signs of use or wear, the Online Store has the right to reduce the refundable amount in accordance with the decrease in the value of the goods.
Upon receipt of the returned goods, the Online Store shall refund all payments received from the buyer under the contract without delay, but no later than 14 days after receiving the withdrawal notice.
The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the online store was marked significantly below the market price due to an error.
Right to File a Claim
The Online Store is responsible for any non-compliance or defect in the goods sold to the buyer that existed at the time of delivery and which manifests within two years from the delivery of the goods to the buyer. During the first year from the delivery of the item to the buyer, it is presumed that the defect existed at the time of delivery. Rebutting this presumption is the responsibility of the Online Store.
In the event of a defect, the buyer has the right to contact the online store within two months by sending an e-mail to info@tarcon.ee.
The Online Store shall respond to the consumer’s complaint in writing or in a format that allows for written reproduction within 15 days.
Direct Marketing and Processing of Personal Data
The Online Store uses the personal data entered by the buyer only for processing the order and sending the goods to the buyer.
The Online Store will send newsletters and offers to the buyer’s e-mail address only if the buyer has expressed a wish to receive them by entering their e-mail address on the website and indicating their desire for direct mail notifications.
The buyer can opt out of offers and newsletters sent to their e-mail at any time by notifying us via e-mail or by following the instructions provided in the e-mail containing the offers.
Dispute Resolution
If the buyer has any complaints regarding the Online Store, they should be sent to the e-mail address info@tarcon.ee.
If the buyer and the Online Store are unable to resolve the dispute through agreement, the buyer may turn to the Consumer Disputes Committee. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer’s complaint by the committee is free of charge.
The buyer may turn to the European Union’s online dispute resolution platform.
Buyer’s Obligations
The buyer must provide accurate and correct personal data, contact information, and delivery address. Providing false information may lead to the cancellation of the order or delivery problems.
The buyer must make the payment according to the terms and deadline specified by the seller. The order is considered confirmed only after the payment has been received by the seller.
The buyer must review and check the order before submitting it, ensuring that all selected products and quantities are correct.
If the seller requires additional information to fulfill the order or resolve a problem, the buyer must be cooperative and respond to inquiries quickly and honestly.
The buyer must respect the seller’s privacy terms and keep confidential all information received concerning the seller’s business activities and other customer data.
The buyer is obliged not to share the purchased products with third parties for consumption. The purchased products are intended for use only by the person in whose name the user account was created.
The buyer is prohibited from recording the products with a screen recorder or any other device capable of filming.
When sharing video material with third parties or recording it, TARCON OÜ has the right to issue a fine of up to €1,500 to the violator.
Buyer’s Rights
The buyer has the right to receive complete and accurate information about the products for sale, including their characteristics, prices, availability, and delivery terms.
The buyer has the right to receive appropriate and timely customer support. The seller must provide clear and simple ways to obtain customer support, including contact information and support channels.
The buyer has the right to file complaints if they are not satisfied with the products or services received. The seller must provide a clear process for submitting complaints and resolving them within a reasonable time.
The buyer has the right to receive purchase documentation, including an invoice, which clearly shows the details of the transaction, such as product name, price, quantity, taxes, and delivery costs.
The buyer has the right to review the seller’s terms of use, privacy policy, and return conditions before making a purchase. These documents must be easy to find and understand.
The buyer has the right to consume the purchased products for 12 months from the date of the purchase transaction.
The buyer has the right to consume the purchased products multiple times during the time period mentioned in the previous paragraph.
Seller’s Obligations
The seller is obliged to allow the Buyer to consume the purchased products for 12 months from the moment of the purchase transaction. The seller enables the Buyer to consume the courses through the training platform, providing the Buyer with access after the purchase transaction.
The seller must ensure that orders are fulfilled on time and that products are delivered at the agreed time and in the agreed manner. The seller must inform the customer of any possible delays or changes.
The seller must ensure that all products sold comply with descriptions and quality standards.
In the event that products disappear from the Buyer’s user account for reasons not related to the expiration of the term, the Seller has the obligation to restore the products to the Buyer’s user account.
The seller must provide the buyer (training participant) with the necessary support and advice before and after the training.
The seller must provide clear and transparent pricing and avoid hidden costs.
The seller must collect, process, and store the customer’s personal data in accordance with applicable privacy and data protection laws.
The seller must comply with all local and international laws and regulations related to e-commerce, including consumer protection, taxation, and trade rules.
The seller must ensure that the security of the online store is guaranteed, protecting customer data and payment processes. The seller must implement measures for the prevention and detection of fraud.
Seller’s Rights
The seller has the right to change the terms of use and prices of the online store at any time. Such changes take effect from their publication on the website.
The seller has the right to refuse to provide a service or fulfill an order if suspicions of fraudulent activity, inaccuracy of data, or other justified reasons arise.
The seller has the right to terminate the Buyer’s consumption of purchased products before the deadline if the Buyer has violated the conditions set out in the chapter “Buyer’s Obligations”.
The seller has the right to remove or change online courses at their own discretion. In the event that the Seller wishes to remove an existing course, but the selected course is currently being consumed by one or more Buyers, the Seller must allow them to complete the course until the end of the term.
The seller has the right to demand additional information from the buyer if it is necessary for fulfilling the order or identifying the customer.
The seller has the right to collect and use the customer’s personal data in accordance with the privacy policy and applicable laws, for example, for marketing purposes or for fulfilling orders.
The seller has the right to organize various campaigns, discount offers, and sales promotions at their own discretion.
